Abstract
On 14 December 2021, the European Commission issued a Proposal for a Regulation amending Regulation 2016/399 regarding a Union Code on the rules governing the movement of persons across borders (commonly known as the Schengen Borders Code). This is not the first time the Commission has proposed changes to the Code since the arrival of more than expected numbers of refugees in 2015-2016. Most recently, the Back to Schengen Communication of 2017 proposed changes to the Code to improve its operation. However, these efforts have perhaps not succeeded as fully as the Commission would have hoped.
